All he had to say was he wasn't driving. He was at the bar, had too much to drink, and someone offered to drive him home so he let them. They proceeded to speed and then run out of gas. They ran away. He doesn't know who they are.

Obviously the cops didn't see exactly who was driving. Let them prove it was him.

If they're going to send him to jail, it won't be for lying....besides....he was drunk....he probably doesn't even know what he is saying....and if it all goes south....that would be his defense.

But you NEVER admit to anything. Make them prove it. If they didn't actually see him driving, how can they arrest him for driving. He was pushing the car when they got there. People have gotten off of more serious crimes for less. Never admit to anything.
